Tripura Govt. to approach HC again appealing to stay Law Secretary D. M. Jamatia’s transfer order

AGARTALA, July 28 (TIWN): After the Tripura High Court had rejected appeal to stay the transfer order of state law secretary Data Mohan Jamatia, the state Left front government has decided to approach the court again demanding the same. “We would again approach the HC appealing to stay the transfer order of Jamatia till January 16,” said Law Minister Tapan Chakraborty. Jamatia was transferred on July 15 and Chief Secretary Y. P. Singh was asked by the HC to induct new law secretary immediately replacing D. M. Jamatia. Jamatia was supposed to join as new District and Session Court Judge (Unakoti) on August 3 this year but Minister Tapan Chakraborty expressed his inability to release Jamatia now saying that there are several pending assignments with Jamatia and it needs to be restored. Chakroborty said, “Jamatia has been looking after the state government’s appeal to the Supreme Court against the HC’s job dismissal case.” The Minister in a letter to the HC on July 20 expressed the state government’s inability to relieve Jamatia from his responsibilities as a state law secretary. “We are not is a tussle with the HC and its direction rather the state government wants to maintain the relation with the HC.

Therefore we would again approach the HC to stay the transfer oreder of D. M. Jamatia expressing our difficulties,” Chakraborty said.On being asked Chakraborty said to the reporters, “There is no requirement to move to the SC regarding this because the state government has simply expressed its difficulties with the transfer of Jamatia.”

However, Jamatia is fighting against the HC of Tripura in the SC, for drawing a contempt proceeding by the HC for his alleged derogatory remark against the Chief Justice and the high court in a file note which was published in the media early this year.  

It is worthy to be mentioned here that the removal of Jamatia from the law secretary post had left the state government in dilemma now as the government finds no alternative to the pending cases with the SC which were earlier handled by Jamatia.

Besides, another question triggered which indicates that, if Jamatia is back tracked, from join the new post being directed by the HC, then this would again bring another major problem for the state government.
