Former Law Secretary D.M.Jamatia’s appeal cancelled: Criminal Content case next High Court hearing on April 5, HC orders to submit the relevant documents into the case

AGARTALA, March 16 (TIWN): The PIL filed into the case of making derogatory comments against the court was put up in the HC on Wednesday. It is to be mentioned here that former Law secretary Data Mohan Jamatia appealed to court not to present the documents of the department of the Home ministry and others however the appeal was cancelled by the court and the next hearing of the case will be done April 5. Countering the orders of HC, Former Law secretary had appealed to HC not to submit the documents in court; however, the court on Wednesday rejected the appealed of Jamatia and asked to submit the reports by April 5. Believed to be one among the very few confidants of Manik Sarkar, the former Law Secretary Datamohan Jamatia’s tangle with the High Court has only added to the woes of the chief minister. The feud between the State Law Secretary with the High Court started with the case relating to the state Government’s reservation policy on promotion in Govt. jobs which was defended by the Law Secretary and in the process the Law Secretary put the most controversial note alleging the Chief Justice of personal ill will against him and Sankari Das, the Deputy law Secretary in the state law department.

 Tripura High Court took up a suo moto contempt of court case against the Law Secretary Datamohan Jamatia for his controversial note defaming the Chief Justice and framed charges against the Law Secretary which may lend up the state law secretary in jail if proved guilty.

The High Court of Tripura had framed a charge against Law Secretary Data Mohan Jamatia on Criminal Content of Proceedings. The charge was framed according to the Act 15 of the law contempt. On the other hand, Court had also instructed to submit the name of the witnesses and the necessary documents on April 5

It is to be mentioned here that quite surprisingly violating his limit as a Law Secretary D M Jamatia in his note forwarded to Chief Minister Manik Sarkar and used the following remarks: ­

1” ) The Chief Justice become furious and directed to initiate contempt case against Deputy Secretary (Law) and against the undersigned but not against the Advocate General who has examined the sane issue and endorsed our views"

2)"... ...the High Court, with preconceived mood, has initiated contempt case against 2(two) of us who participated in the total process of exchange of views. The does not permit it... ..."

 3) "... ...We are afraid whether the High Court will damage our service records or career. The Chief Justice is trying demoralizing us so that no views can be given against any order of the High Court.... ..."

It is alleged that to hide his inefficiency Datamohan has used humiliating attacks against the Chief Justice and the High Court. However, the hearing of the case will be done next on April 5.
