Regional Conference on Mediation: 'Mediation is the best method to resolve cases', said Supreme Court Judges Justice Madan B. Lokur

AGARTALA, Nov 28 (TIWN): A two- day long regional conference on mediation has been organized on November 28 at the auditorium of Tripura High Court.

Inaugurating the programme, Supreme Court Judges Justice Madan B. Lokur spokes about mediation and how is it different. Besides, he also discussed about what a mediator does.

He further mentioned that mediation was one solution to problems on number of pending cases and the idea was to provide justice to the people fast and making it affordable.

Besides, he said that we needed to aggressively promote mediation as it was the best method to resolve cases.

Mediation and Conciliation Project Committee (MCPC) constituted by the Supreme Court of India to speedily resolve issues between people will be further strengthened and there is also a plan to adopt the concept of community mediation centres by next year so that the burden of pending cases can be reduced in the courts.

It has been mentioned that a mediator introduces himself to the parties and explains the mediation process and establishes his neutrality. He further explains the ground rules and initiates the confidential process of dispute resolution.

In a joint session the mediator gathers information about the factual background and interests of the parties, establishes interaction between them and creates a suitable environment for an amicable settlement.

Besides, during an individual session a mediator allows the disputing parties to further explain their grievances, continues to gather information, persuades individual parties to share confidential information and helps them to create options for an amicable settlement.

Later a mediator confirms and clarifies the terms of settlement and reduces the settlement into a clear, complete, concise and binding agreement.

During the inauguration for the regional consultation on mediation, along with two Supreme Court’s Judges Justice Madan B. Lokur and Justice Amitava Roy, Justice Laxmi Kanta Mohapatra, chief justice of High Court of Manipur were also present.

However, expressing the benefits of mediation it has been mentioned that mediation is quick and responsive process, economical. There is no extra cost, harmonious settlement, creating solution and remedies, confidential and informal and parties controlling the proceeding.
