Failing to comply order: High court  issues stern warning to police officer, exempted from  censor

AGARTALA, Oct 7 (TIWN): By seeking unconditional apology in high court, the officer – in – charge of Birganj police station Sunil Kumar Das was exempted from service censor. On Tuesday, Chief Justice Deepak Gupta gave stern warning to the police officer in the court room and if repeated again than the court will be compeled to take action. Chief Justice Gutpa took a suo – motto case against the OC for not following court order.It is mentionable here that a property case was registered against Amar Das, local of Amarpur sub division. Arrest warrant was issued agaisnt him. To evade arrest , Amar Das filed anticipatory bail in the high court.On May 19, the court granted anticipatory bail, accordingly Amar Das was directed to submit a judgment order copy at Birganj police station. On way to police station he was brutally attacked by miscreants. He was critically injured. Later after getting information police took Amar Das to hospital, where he succumbed to injuries. Before breathing his last in a statement he gave the names of eleven miscreants to police. All are resident of Kamaria khola under Birganj police sation.Ashu Das, wife of the deceased registered an FIR against all eleven miscreants at Birganj police station. But no FIR was registered til June 3, 2015, moreover the OC sought guidance from the ruling party panchayat pradhan. Not only that all accused were seen roaming freely in open.

The matter was published in print media.After seeing  the news Chief Justice took a suo – motto case the OC  o f Birganj police staion on June 11, 2015 and issued notice. 

After getting notice next day out of eleven eleven miscreants ten of them were arrested.

In a similar case earlier the high court have issued notice to DGP and home secretary FIR should be registered immediately against any criminal offence. 

If no FIR is registered, police should register a suo – motto case. The court directed to sent the notice to all police station and strictly follow the order.
