Agartala, Sept 23 (TIWN):The High Court of Tripura in a judgment directed the state health department to reinstate one of its inspecting officer ( drugs) who was suspended illegally. On June 26, 2000, the health department suspended Dhiman Singh, inspecting officer for alleged negligence in duties. Departmental inquiry started against him under CCS ( CCA) rules 1965.
The vigilance department after inquiry found the allegations against Dhiman is false. However, the state government did not accept the report, accordingly on May 19, 2005 by an order directed the authority to conduct another inquiry. The accused raised objection on second inquiry which the authority declined.
After second inquiry Dhiman was found guilty, on May 19, 2005 suspension order was issued by health department. Challenging the suspension order writ petition was filed in the High Court. On September22 (Tuesday) the division bench comprising of Chief Justice Deepak Gupta and Justice S.C. Das gave final hearing on the petition.
The counsel for writ petitioner, P. Ray Barman during hearing stated that when in first inquiry the allegation against the accused was found false, ordering second inquiry on same allegation was illegal. After hearing both counsels, the division bench rejected the second inquiry report and ordered to reinstate the suspended writ petitioner. Besides, the court also ordered to give all kind of financial benefits with interest from the day Dhiman was suspended. P.Roy Barman was counsel for writ petitioner assisted by two other counsel Samarjit Bhattacherjee and Koushik Nath.
