10,323 teacher termination case: Hearing of Interlocutory application in Supreme Court on December 8 : Teachers fate uncertain

AGARTALA, December 4 (TIWN): The hearing of the interlocutory application filed by the State Government will commence on December 8 at Supreme Court. On the other hand, State Government still in a confusing situation about the fate of the 10,323 teachers. Speaking to TIWN, Law Secretary Datamohan Jamatia told that the hearing on interlocutory application will commence on 8th December. This hearing will decide the fate of the 10,323 teachers whether their termination by High Court order stands for 31st December’14 or their jobs can be extended by a new SC stay order. A highly informed source stated that, if State Government fails to win the 10,323 teacher termination case in the Supreme Court, most of the disgruntled teachers will file criminal case against the Manik Sarkar's Government. School Education Department suffered a major jolt as Registrar of the Supreme Court declared on Oct 27 that the 'Hearing on the Teachers Recruitment Rules of the state' govt will be held on 9th January 2015 which was declared ' Unconstitutional' on May 7 by the Division Bench of High Court headed by Chief Justice Deepak Kumar Gupta and Justice Swapan Ch Das.

Further the State Government had filed a petition to the Supreme Court to put a stay order on High Court's ruling .The Supreme Court on 27th October did not say anything in this case. Even the matter was not at all raised in the SC for hearing. Rather the date of hearing was decided by the Registrar. And the next hearing is on 9th January i.e., after the termination date as per the ruling of the Division bench of the High Court comprising Chief Justice Deepak Kumar Gupta and Justice S C Das.

The question arises in present moment are:

1) Why did the govt take refuge in lies from the very beginning on teacher’s recruitment? Why Manik Sarkar’s Govt played with the lives of 10323 families ?

2) Has the govt got hint from legal experts that it will lose the case in the SC?

3) Is the Interlocutory appeal another attempt to be fool the people?

4) If the hearing on Interlocutory Application date too is finalized after 31st December what will be the Govt's step? As High Court order stands for all10323 teachers termination on Dec 31st, so how Govt will face these 10323 families statewide ?

5) Is the Govt worried after it learnt that the case will be dealt with Abhishek Manu Sangvi and in that case a sure defeat is awaiting.

It is to be mentioned here that the High Court of Tripura on May 7 issued an order for the termination of services of 10,323 teachers as the State government did not follow the justified process for their selection.. After that the Government appealed to Supreme Court to  put a stay order on High Court’s judgment. On the other hand, a section of the job aspirants among 10,323 teachers will file a criminal case against the State Government. 

It is to be mentioned here that the Supreme Court in the year 2009, issued a notification that in case of appointment of teachers new education policy should be followed. As per the notification, Central Government had instructed the State Governments to take this policy in action. But the State Government of Tripura turned a deaf ear to this to accommodate CPIM party cadres and still no education policy was implemented. On the other hand the job form for the interview of the undergraduate, graduate and post graduate teachers are called in the year 2002, 2003 and 2006. But the candidates are called for interview in between the year 2010-2013.During this gap, State Government if wishes can implement the policy. But travelling hither and there, no action had been taken. Inspite of that on a sudden decision, in the year 2013 on Christmas Day, the Cabinet decided to appoint 10,323 teachers in undergraduate, graduate and post graduate level.
