AGARTALA, July 18 (TIWN): Tripura High Court in a landmark verdict saved contractual workers’ livelihoods under Govt Depts and said that no contractual employee can be terminated without prior notice, show-cause letter and giving self-defending chance to the employee. Only after Justification, Surrenders, an employee can be terminated.
Contractual employees, the various Associations leaders have marked the decision as "historic" and said it is moral victory of the hardworking contractual employees.
In a writ petition filed by a terminated contractual employee Paresh Debnath, who was terminated without show-cause notice, Chief Justice Akil Abdulhamid Kureshi has given the verdict.
Also, the Court has asked Tripura Govt to reappoint this person immediately to his previous post by 1 month and to clear 50% of all unpaid salaries by next 4 months.
The petitioner Paresh Debnath was appointed in GRS posts from 2011 but in 2018, November under Dhalai DM's order, the BDO had terminated him with bundles of allegations.
As per Article-14, there is no chance of authoritarianism in Govt jobs. Senior Advocate Purushottom Roy Barman held legal battle on behalf of the petitioner.
