Illegal Appointments under BJP Minister’s recommendation : High Court issues notice to Tripura Chief Secretary, 7 more officials

AGARTALA, Dec 15 (TIWN): Saddam-era of brutal termination of employees once again hit by constitution. Amid Tripura Chief Minister’s Biplab Deb’s claim of no recruitment scam held in Tripura under BJP Govt's 9 months, for the second time High Court has show-caused the Govt for irregularities in recruitment and merciless termination of employees. The High Court issued stay order on the illegal termination of one pump operating employee Uttam Deb and recruitment of new pump operator under BJP Minister's recommendation. Earlier High Court had issued notice for irregularities in recruitment of advocates in Udaipur Dist Court. In a notice, this time Tripura High Court along with issuing stay order on the termination of the previous pump operator one Uttam Deb and recruiting new pump operator; also issued notice to the Chief Secretary Lalit Kumar Gupta to show-cause for such irregularities. Along with Chief Secretary more 7 persons including Panchayat Secretary was also served with show-cause letters.

Uttam Deb of Dhala District was recruited in 2016 as pump operator but suddenly on November 19, on the recommendation of Minister Manoj Deb, Uttam Deb was lettered to be replaced by one Joyjit Mandal. Joyjjit Mandal was recruited under recommendation of Minister Manoj Deb.

It was said in a recommendation letter that till Joyjit Mandal joins work, Uttam Deb will continue the work, but nowhere Uttam Mandal was ordered for termination. However, Uttama Deb filed a case in the High Court on the  basis of that letter.

On behalf of Uttam Mandal, advocate Biplab Debnath told the High Court that a Minister has no power to recommend a person in a departmental recruitment.

Moreover, in case of termination, a person has to be given proper notice under Act 311 and then the employ’s answer will depend whether to terminate him or not.

According to 21 section of the constitution, this decision has hit the “Right to live” and “Right of Livelihood” of Uttam Deb. At the same time, how Minister can recommend a person for appointment the Advocate it has raised question and the petitioner also demanded the BDO’s suspension.

Noteworthy, under BJP Govt around thousand of employees who were working in contract were terminated. Forest Dept’s 35 employees were threatened by police force when they went in hunger strike and later they warned to commit suicide for Govt’s illegal termination, but till day the State Govt has not recruited them.
