NBFCs: 101 people arrested, amount defalcated more than 17.6 crores

AGARTALA, August 11 (TIWN): Since 2010, one hundred thirty eight NBFC cases have been registered in the state admitted chief minister Manik Sarkar. Laying the statement in assembly today he stated that the state government on 12th May, 2013 requested Centre for entrusting the investigation of thirty seven NBFC cases to CBI. The centre accepted transfer of investigation in respect of five NBFC cases to CBI. Informally it was communicated that cases are not of such nature that warrant investigation of by CBI.

It was also indicated that the cases are of local nature and the amount involved does not justify deployment of scarce resource of CBI for investigation of the cases.

The chief minister also sought intervention of the then prime minister Manmohan Singh for entrusting investigation of all the 37 cases referred to CBI.

 However, the investigation of no other NBFC case was taken by CBI afterwards.The High court of Tripura while dealing with ( Dipti Das Majumder Vs The state of Tripura & Others) vide order dated 19 – 3 -2015 and 09- 04-2015, asked the state government to constitute an Special Investigation Team (SIT) for investigation of NBFC cases.

 Accordingly the     state government on 13 April 2015 constituted an SIT consisting of following members – IGP (Admn) is head of SIT

101 persons were arrested till date involved with NBFC cases and 1957 persons were examined. More than 22000 documents are collected. Amount defalcated base on investigation carried so far is around Rs 17.6 crore.

However amount of defalcation in many cases is yet to be ascertained and could not be calculated due to non availability of balance sheet, profit and loss account and examination of CA etc. All cases properties have been referred to concerned DMs. The high court is monitoring the investigation of NBFC on regular basis. The next date of hearing in the court is 28th August.
