Tripura gets law secretary D M Jamatia in chair for 3 months, HC reserves Jamatia’s transfer order

AGARTALA, August 2 (TIWN): Finally after several appeal to the High Court the Tripura managed to get its law secretary Datamohan Jamatia in chair for another three months. The High Court on Saturday hearing the appeal of the State Minister for Law Tapan Chakroborty for the second time finally reserved the transfer order of Jamatia and had offered more three months to Jamatia in chair.

Law minister Tapan Chakroborty on July 30 had shooting off a fresh letter to the High Court had sobbed to get law secretary D M Jamatia in chair till January 16, 2016. However, but the HC on Saturday hearing the fresh appeal reserving the transfer order of Jamatia had offered another three months time to restore the pending cases which had with the department.

Talking to TIWN this evening before the HC had pronounced its decision Jamatia said, “I am ready to accept the decision whatever the court takes responding to the approach of Law Minister.” He also said, “I was supposed to join as a Unakoti District and Session Court Judge on August 3 but at this moment I cannot say anything until the Court takes its decision.”

Though later Jamatia was found unavailable over phone after being contacted to know how he respond to the HC’s decision.

According to the early order of the HC Law Secretary D M Jamatia was supposed to join as a new District and Session Court Judge of Unakoti District on August 3 this year.

The state law department finally managed to overcome from the tussle it had with the High Court regarding the transfer order of Jamatia. Minister Tapan Chakroborty approaching the High Court for the second time was in opinion that the department requires Jamatia in chair as he is looking after the state government’s appeal to the Supreme Court against the HC’s job dismissal case and other pending cases in the Supreme Court and also forthcoming elections to local bodies.   

The fresh letter was issued to the high court after it turned down the Law minister's plea on July 23 and adhered to it earlier decision.    

The High Court had issued a notification on July 14 transferring Jamatiya from the post of Law secretary and asked him to take the charge of District Judge of Unakoti on August three.

The court also asked state Chief Secretary Y P Singh to relieve Jamatiya from his present post and appoint a new Law Secretary. A contempt of court case against Jamatiya is pending in the Supreme Court.

The law minister also raised questions over the appointment of Unakoti District Session Judge Gautam Debnath as officer on special duty (OSD) in the high court.

"The high court may appoint OSD but the post has to be created by the state government before any posting is made, as otherwise financial and other complications will arise in future," the law minister said in his letter.

A division bench of the high court in April previous year wanted contempt of court charges to be framed against Jamatia for making remarks against the judiciary in an official note to Chief Minister Manik Sarkar, which, according to the court, was contemptuous.

However, Jamatia, denied the charge and filed a petition before the Supreme Court.
