AGARTALA, May 24 (TIWN): A police official Nandan Kumar Debbarma was held by police after local people created turmoil in his home for staying with a woman without marriage and not divorcing his own wife.
Both the man and woman are married but they are not divorced yet.
The BJP local members at first came to their home along with local people there and after talking to them, they called police, informed media. This incident created a tension in the whole area.
Later police arrived and took both of them to police station.
Supreme Court in 2018 said that extra marital affair is not a crime. However, the offence still remains a valid ground for divorce. In 2018, 28th September, the Supreme Court struck down as unconstitutional the 158-year-old Section 497 of IPC that punished a married man for the offence of adultery if he had sexual relations with a married woman "without the consent or connivance of her husband", but said adultery could continue to be a ground for divorce.
However, it does not say about the Live-in-together without marriage. Allahabad HC on January 29, 2021 said In an interesting order, that a married woman who is in a live-in relationship without ending her marriage first is committing a crime and her partner is also culpable.
