Implementation of new recruitment policy for teachers from Tuesday

Agartala, November 25 (TIWN): Under the immense pressure of the High Court, the State Government at last made a decision to frame new recruitment policy of teachers from Tuesday. Earlier, a division bench of the Tripura High Court, comprising Chief Justice Deepak Gupta and Justice Swapan Chandra Das, in its judgment on May 7 terminated the jobs of at least 10,323 government school teachers citing discrimination and misdeeds. The high court had also asked the state government to arrange a fresh recruitment process by December 2014 and frame a new employment policy within two months .

Tripura's left front Government recruited 1,100 post-graduate and 4,617 graduate teachers in 2010 and 4,606 under-graduate teachers in December 2013.The high court, after hearing the state government and the complainants, passed the order on a batch of 58 petitions filed by those who had failed to secure jobs as government teachers.

It is to be mentioned here that the High Court of Tripura on May 7 issued an order for the termination of services of 10,323 teachers as the State government has not followed the legal process in regard of their selection. Later acting on the HC order the Government appealed to the Supreme Court to take proper action in the termination issue of the teachers. Whereas the state govt. had already filed an interlocutory application to the SC and are now expecting the hearing at the last of this month.

A section of the job aspirants among 10,323 teachers will file a criminal case against the State Government. A highly informed source states that, if State Government failed to win the 10,323 teacher termination case in the Supreme Court, most of the teachers will file case against the Government.

It is to be mentioned here that the Supreme Court in the year 2009, issued a notification that in case of appointment of teachers new education policy should be implemented. As per the notification, Central Government had instructed the State Governments to take this policy in action. But the State Government of Tripura turned a deaf ear to this and still no education policy was implemented. On the other hand the job form for the interview of the undergraduate, graduate and post graduate teachers are called in the year 2002, 2003 and 2006. But the candidates are called for interview in between the year 2010-2013.During this gap, State Government if wishes can implement the policy. But travelling hither and there, no action had been taken. Inspire of that on a sudden decision, in the year 2013 on Christmas Day, the Cabinet decided to appoint 10,323 teachers in undergraduate, graduate and post graduate level.

But after that, the High Court had passed a jurisdiction mentioning the termination of the 10,323 teachers. In view of these, Government had also filed a case to save the fate of these teachers. In the first sitting, Court had decided to put a stay order in the employment policy and the guidelines of the High Court. But no stay order had been put on the tenure of the service.

Now even the fortunate job seekers too have realized that the Supreme Court has issued a stay order only on the govt.'s recruitment policy that was declared unconstitutional by the Division bench of Deepak Kumar Gupta. They have now also realized that by the name of challenging the case in the Supreme Court, CPI (M)'employees wings rather raised the party fund with Rs 10 crore by collecting donations (?) from those who jobs were terminated and other employees.  All are scared that if the Supreme Court says that the HCs judgment will remain unchanged; there will be serious breakdown in the law and order situation.
