SC: Repetitive Sec 144 orders would lead to abuse of power

New Delhi, Jan 11 (TIWN) Section 144 of the Code of Criminal Procedure (CrPC), which prohibits assembly of four or more people, enables the state to take preventive measures to deal with imminent threats to public peace. This section is also imposed to clamp down on protests in highly sensitive areas, especially in the area around Parliament when it is in session.
In its judgment on restrictions imposed on movement of people in J&K after the August 5 decision to remove its special status and divide it into two Union territories, the bench said, "Power under Section 144 CrPC cannot be used as a tool to prevent legitimate expression of opinion or grievance or exercise of any democratic rights."
