NCLT, NCLAT can encourage, not direct settlements under IBC: SC

New Delhi, Dec 17 (TIWN) The Supreme Court on Tuesday said that the adjudicating authority (NCLT) and appellant authority (NCLAT) under the Insolvency and Bankruptcy Code (IBC) cannot compel parties to settle a dispute.
The respondent was directed to settle all remaining claims by the end of three months. This left the door open for the original petitioners who were aggrieved at the settlement to bring fresh proceedings.
