AGARTALA, August 21: Having failed to register a complaint by a police station, High Court of Tripura issued show cause notice to Chief Secretary and DGP on Thursday. The affidavit should be submitted in court on 9 September next. Besides, the court directed to mention in the affidavit why police station fails comply the Supreme Court order. The order was given in hearing on Thursday, when contempt of court by Birganj police station by division bench headed by Chief Justice Deepak Gupta.According to report, on 31 May 2013 at six in evening Amar Das was brutally murdered in his resident under Birganj police station. After two days, i.e is on 2 June, the police station took the murder case. He was murdered for land related issues.Chief Justice Gupta took a somuto case on the issue. On last hearing, OC of Biraganj police station Sunil Kumar Das was ordered to remain present physically in court on 20 August to tell court why case was registered after two days of murder. Accordingly, the OC appeared in court and begged pardon. The court pardoned him, along with Chief Secretary and DGP was orderd to reply why police station’s take time to register complain. By 9 September, both were directed to submit affidavit in the court.
As per Supreme Court order it is mandatory for the police to register a First Information Report or FIR when a complaint is filed at a police station. Before the order, it was upto the police to decide whether to formally accept a complaint, though the Criminal Civil Procedure code says police must register FIR on receipt of complaint.
The judges said that action will be taken against an officer at a police station if he fails to register an FIR, which is the first step towards the filing of formal charges.
