AGARTALA, Dec 6 (TIWN): Special Judge Court has rejected Badal Choudhury’s bail petition after one day of the hearing ended, but it was rejected due to technical error as already earlier in High Court Badal Choudhury’s bail was once rejected and the FIR squashing case’s hearing on December 10.
The Court order have stated however that Police failed yet to produce proper C/D and required documents yet. (On December 4, on behalf of former CPI-M Minister Badal Chowdhury, advocates have filed a fresh bail petition in Special Court and sought Badal Chowdhury’s bail)
Another case is pending in the High Court which was filed in squashing appeal of the politically motivated FIR against Badal Choudhury in the West Agartala PS even after an Assembly decision.
Thus, now Badal Choudhury’s side have to wait till December 10 what the High Court passes order.
The points came out today in the special judgement in simple words are below :
1) Although in Special Court and High Court two cases are filed differently but the subject matters of both cases are same,
2) CD shows investigation is in progress but there is no evidence that the accused did not help or cooperate the investigating officer,
3) The gravity of the alleged crime is high although proper documents yet to be submitted properly.
4) With all factors of both sides, Special Court has left the matter up to the High Court verdict on December 10.
