Law department takes action against two judicial officer – Prakash Chandra Biswas and Jesthamani Murasingh

AGARTALA, Oct 30 (TIWN): The law department took departmental action against two judicial officers - Prakash Chandra Biswas and Jesthamani Murasingh. A notification was issued in this regard on Thursday. The notification regarding Prakash Chandra Biswas stated that an inquiry proceeding against the delinquent official was started on the basis of two newspaper reports which reported that Prakash chandra Biswas had been caught cheating while appearing in one of the papers of the Ph.D. Course Work Examination held on 19.02.2014. Since the newspaper reports levelled serious allegations against the delinquent official, the delinquent official was placed under suspension and inquiry proceedings was initiated by the High Court of Tripura. And whereas on completion of the inquiry, the inquiry Officer submitted the inquiry report to the High Court of Tripura and in the inquiry Biswas, Distirict Secretary, District Legal Services Authority, Gomati Judicial District, Udaipur ( a Grade-II Member of the Tripura Judiciat Service) was found guilty. The High Court of Tripura in its Full Court meeting held on 23.09.2015 has resolved to recommend the penalty of compulsory retirement from service upon Biswas.

The resolution of High Court was submitted to the State Govemment for consideration by the appropriate authority; AND WHEREAS, the matter has been considered by the appropriate authority of the State Government. NOW, therefore, the Governor, acting upon the said recommendation of the Hon'ble High Court of Tripura, has been pleased to order that Biswas, is hereby compulsorily retired from service with immediate effect.

On the other hand  basis of report dated 02.08.2014 of the District & Sessions Judge, North Tripura Judicial District ( now Unakoti Judicial District, Kailashahar) a Departmental Proceeding was drawn up against  Jesthamani  Murasingh the then Judge, Family Court, Udaipur, South Tripura Judicial District, now posted as Addl. Secretary, Law, Govemment of Tripura; AND WHEREAS, at the time of Departmental Proceedings the following Article of charge was levelled against Shri Murasingh That, Shri Jesthamani Murasingh while functionlng as Judge, Family Court, Udaipur, South Tripura Judicial District, on his application, was granted Earned Leave for 7(seven) days by the Hon'ble High Court w.e.f, 01.08.2014 to 07.08.2014 on the ground of his family affairs with station leave permission after the office hours of 31.07.2014 till before the Oflice hours of 08.08.20r 4; AND That, as reported by the District & Sessions Judge, North Tripura Judicial District, Kailashahar that on I't August, 2014 in the afternoon, Shri Jesthamani Murasingh appeared in the Court premises at Kailashahar in drunken condition and misbehaved with i Sanjoy Bhattacharjee, Civil Judge(Sr.Division) & Asstt. Sessions Judge, North Tripura Judiciql District, Kailashahar and also shoved some furniture of the Office of the Civil Judge (Sr.Division) & Asstt. Sessions Judge, North Tripura Judicial District, Kailashahar. Said fact was also confirmed by Shri A. Pal, Chief Judicial Magistrate, North Tripura Judicial District, Kailashahar over telephone to Shri Goutam Debnath. Then i Goutam Debnath went to the Court premises of the Chief Judicial Magistrate, North Tripura Judicial District, Kailqshahar. As further reported, Shri Jesthamani Murasingh at that time was improperly dressed.

He was then wearing a short pant & T-shirt and ultimately, after removing the T-shirt he kept it on his shoulder; AND WHEREAS, such act of miscoridrct and misbehavior of Shri Jesthamani Murasingh is unbecoming of a Judicial Officer and he thereby failed to maintain the dignity, integrity and high standards of conduct of a Judicial Officer, and thus he has violated the Code of Conduct of a Judicial Ofhcer prescribed in the Tripura Judicial Service Rules,2003 and committed grave misconduct; AND WHEREAS' the matter was placed before the Hon'ble High Court for consideration and Hon'ble High Court of Tripura in its Full Court meeting held on 07. 10.2015 has resolved to recommend for imposing purirshment of withholding of two increments f,or the next 2(two) years without cumulative effect upon  Jesthamani Murasingh; AND WHEREAS, the resolution of Hon'ble High Court was submitted to the State Government for consideration by the appropriate authority; WHEREAS, the matter has been considered by the appropriate authority of the State Government.

NOW, therefore, the Governor, acting upon the said recommendation of the Hon'ble High Court of Tripura, has been pleased to order that Shri Sh,ri Jesthamani Murasingh, the then Judge' Family court, udaipur, south Tripura Judicial District, now posted as Addl' Secretary, Law' Govemment of Tripura is hereby imposed punishment of withholding of 02(two) increments for the next two years without cumulative effect'
