‘Physical Attackers can’t be arrested…….’, Tripura Law Minister’s Low-Statement shocked Legal Experts

AGARTALA, July 7 (TIWN): Turmoil is running over Tripura politics after State’s Law Minister Ratanlal Nath had given a strange statement over Police’s arresting access of the criminals. In multiple statements, the Minister recently made it clear that physical attackers can not be arrested. His statement not only sounded irresponsible but a widow woman who was assaulted in broad day light in allegation of being a witch at Champaknagar, has not seen any hope of justice as police did not make any arrest. To Minister Ratanlal Nath, the attackers can be booked but not subjected to be arrested. As a result, BJP’s former senior leader Prasenjit Chakraborty who was leading BJP when Ratanlal Nath was in another party, was recently beaten, hospitalized but no arrests was done in his case. Rather, police are allegedly directed to plan to put Prasenjit behind the bar.

Tripura Law Minister Ratanlal Nath on 29th June in a press conference has said that the people who attacked in blood donation camps can not be arrested.

His statement was rubbished by legal experts.

However, countering the statement of the Minister CPI-M leader Jitendra Choudhury said that by saying this, the Minister has committed a legal offence, indeed, a ‘Criminal Offence’. CPI-M also has given a press release countering the Statement of the Minister. In the press release, CPI-M stated, “Law Minister has claimed that nobody can be arrested in crimes which are punishable only for 7 years.

Hence, cases can be registered against them - according to Supreme Court’s order, but the claim of the Minister is totally against the Law as in the Criminal Procedure Law (41 No Act) it is said that Police can arrest the person under suspects as by not arresting him, it will give the person a free hand not to remain present on calls and also can manipulate the witnesses”.

CPI-M said, a police can surely arrest a person but proper evidence for arrest should be provided in the court.

“This statement of Minister Ratanlal Nath is to confuse the people”, said the CPI-M in the press release.
