Gratuity payments are Employees’ rights, Fund-crisis can’t be an excuse : Tripura High Court

AGARTALA, Aug 10 (TIWN): Tripura High Court in a hearing has made it clear that fundlessness can not be excuse of not paying employees with gratuities. According to reports, the gratuity delay due to economic crisis claim of the industrial-corporation has been rubbished by the High Court in Tripura. While hearing the pleas, Chief Justice Sanjay Karole said that within 30 days getting gratuities is the right of them. In any condition, this right can not be violated. Small industry corporation’s retired employees Alok Mitra and Sankari Roy who went in retirement in 2018, December filed petition after much time of the retirement. According to the “The Payment of Gratuity Act” their total gratuity has not been given but partial has been given. While asked, the corporation said that due to financial crisis, it is unable to pay off the gratuities, but Chief Justice has made it clear that no excuse will work out in depriving the employees, who dedicated their whole-life service for the organization.

Court has ordered to clear the unpaid amounts within 2 months of the verdict.

Senior advocate Purushottom Roy Barman has represented the  case in the High Court on behalf of the petitioners was assisted by advocate Koushik Nath and Samarjit Bhattacharjee.
